Terms of Service

Welcome to MealRhythm! These Terms govern your use of our meal planning app and website. Please read them carefully.

1) Agreement to Terms

By creating an account, accessing our website (mealrhythm.app), or using the MealRhythm iOS application (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

These Terms form a legally binding contract between you and MealRhythm. We may update these Terms from time to time, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2) Who May Use MealRhythm

Age Requirements: You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Account Creation: To use MealRhythm, you must create an account using Apple Sign In. You agree to provide accurate information and keep your account secure.

Family Invitations: When you invite family members to join your family space, you confirm that you have their permission to share recipes and meal plans with them. You are responsible for who you invite and what content you share.

3) Your Account and Security

Apple Sign In: MealRhythm uses Apple Sign In for authentication. You are responsible for maintaining the security of your Apple ID and any activity that occurs under your account.

Family Codes: Each family has a unique invite code. You are responsible for:

  • Keeping your family code private and only sharing it with trusted family members
  • Not posting family codes publicly or sharing them with unauthorized individuals
  • All activity that occurs in your family space, including by members you invite
  • Notifying us immediately if you believe your family code has been compromised

Account Suspension: We reserve the right to suspend or terminate accounts that violate these Terms or engage in abusive behavior.

4) Acceptable Use

You agree to use the Service responsibly and legally. Specifically, you must not:

  • Violate laws: Use the Service for any illegal purpose or in violation of any laws
  • Infringe rights: Upload content that infringes copyright, trademark, or other intellectual property rights
  • Harm others: Harass, threaten, or harm other users or family members
  • Upload prohibited content: Share unlawful, harmful, offensive, or inappropriate content
  • Abuse the system: Attempt to reverse engineer, scrape, or automate access to the Service
  • Bypass security: Circumvent security measures or access unauthorized areas
  • Interfere with service: Disrupt servers, networks, or other users' experience
  • Impersonate others: Pretend to be someone else or misrepresent your identity
  • Spam: Send unsolicited messages or use the Service for commercial spam

5) Your Content and Intellectual Property

Ownership: You retain full ownership of all content you create and upload to MealRhythm, including:

  • Recipes (titles, descriptions, cooking times)
  • Photos you upload
  • Meal plans and schedules
  • Notes and other personal data

License to Us: To operate the Service, you grant MealRhythm a worldwide, non-exclusive, royalty-free license to host, store, display, and process your content. This license is limited to providing and improving the Service and ends when you delete your content or account.

Sharing with Family: When you mark a recipe as "family" (not private), you grant your family members permission to view and use that recipe. Private recipes remain visible only to you.

Your Responsibilities: You are responsible for:

  • Ensuring you have the right to upload and share any content
  • Not infringing others' copyrights or intellectual property
  • Backing up any content you want to preserve (though we do maintain backups)

Photos: When you upload photos to recipes, you confirm you own the photo or have permission to use it. Stock photos or images found online may be protected by copyright.

6) Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information, including:

  • How we use Apple Sign In for authentication
  • What data we collect (recipes, photos, meal plans, AI suggestions)
  • How we share data within families
  • Your rights to access, export, and delete your data

By using MealRhythm, you agree to the collection and use of information as described in our Privacy Policy.

7) Premium Subscriptions and Payments

Free Features: MealRhythm offers core features for free, including recipe management, meal planning, and AI suggestions for individual use.

Premium Subscription: Family Sharing features require a premium subscription, which unlocks:

  • Real-time sync across family members
  • Shared recipe library
  • Collaborative meal planning
  • Unlimited family members

Apple In-App Purchase: Premium subscriptions are purchased through Apple's In-App Purchase system. By subscribing, you agree to:

  • Apple's payment terms and conditions
  • Automatic renewal unless canceled at least 24 hours before the renewal date
  • Manage subscriptions through iOS Settings → Your Name → Subscriptions

Pricing and Billing: Subscription prices are shown in the app before purchase. Apple processes all payments. We do not store your payment information.

Refunds: Refund requests are handled by Apple according to their refund policy. Contact Apple Support or request a refund through your Apple ID account.

Changes to Pricing: We may change subscription prices with notice. Existing subscribers will be notified before price changes take effect.

8) Third-Party Services and Integrations

MealRhythm integrates with the following third-party services:

  • Apple Sign In: For secure authentication (Apple's terms apply)
  • Apple In-App Purchase: For premium subscriptions (Apple's terms apply)
  • Cloud Storage: For hosting photos and data backups

We do not control these third-party services and are not responsible for their availability, content, or policies. Your use of third-party services is subject to their own terms and privacy policies.

9) Disclaimers and No Warranties

AS IS Service: The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including:

  • Merchantability and fitness for a particular purpose
  • Non-infringement of third-party rights
  • Availability, reliability, or error-free operation
  • Accuracy or completeness of content
  • Security of data transmission

No Guarantee: We do not guarantee that:

  • The Service will always be available or uninterrupted
  • Data will never be lost (though we maintain backups)
  • AI suggestions will be accurate or suitable for your needs
  • The Service will meet your specific requirements

Dietary Information: MealRhythm is a meal planning tool, not a source of dietary or nutritional advice. Consult with healthcare professionals for dietary guidance.

10) Limitation of Liability

To the maximum extent permitted by law, MealRhythm, its affiliates, officers, directors, employees, and agents will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Service interruptions or data loss
  • Damages arising from third-party services (Apple, cloud providers)
  • Unauthorized access to your account or family space

Our total liability to you for all claims arising from or related to the Service will not exceed the amount you paid us in the 12 months before the claim (or €100 if you haven't paid us anything).

Some jurisdictions do not allow limitations on liability, so these limitations may not apply to you.

11) Indemnification

You agree to indemnify, defend, and hold harmless MealRhythm and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Content you upload or share
  • Violation of these Terms or applicable laws
  • Infringement of third-party rights
  • Your family space and members you invite

12) Account Termination and Service Changes

Your Right to Terminate: You may stop using the Service and delete your account at any time from Settings → Account. Upon deletion:

  • Your recipes, photos, and meal plans will be deleted within 30 days
  • Family recipes you created may remain visible to your family
  • Your subscription (if any) will continue until the end of the billing period

Our Right to Terminate: We may suspend or terminate your access to the Service immediately if:

  • You violate these Terms
  • You engage in abusive or illegal behavior
  • We are required to do so by law
  • We discontinue the Service (with notice)

Effect of Termination: If we terminate your account for cause, you will not be entitled to a refund. We will attempt to provide notice before termination when possible.

13) Changes to the Service or Terms

Service Updates: We continuously improve MealRhythm and may:

  • Add new features or functionality
  • Modify or remove existing features
  • Change the user interface
  • Update AI suggestion algorithms

We will notify you of significant changes through the app or email.

Terms Updates: We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top
  • Notify you via email or in-app notification
  • Give you opportunity to review changes before they take effect

Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms. If you do not agree with the changes, you may delete your account.

14) Governing Law and Disputes

Governing Law: These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts in the Netherlands.

Consumer Rights: If you are a consumer in the European Union or another jurisdiction with mandatory consumer protection laws, nothing in these Terms limits your statutory rights. You may have additional rights that cannot be waived by contract.

Informal Resolution: Before filing a legal claim, please contact us at info@mealrhythm.app to attempt to resolve the dispute informally.

15) General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and MealRhythm regarding the Service.

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full effect.

No Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

Assignment: You may not transfer or assign your rights under these Terms without our consent. We may assign our rights to any affiliate or successor.

Language: These Terms are provided in English. If translated, the English version governs in case of conflicts.
